Colorado is a "no-fault" divorce state, meaning neither party needs to prove wrongdoing—only that the marriage is "irretrievably broken." This doesn't mean the process is simple, however. Issues of property division, spousal maintenance, and parental responsibilities must be resolved either through agreement or court decision.

The Divorce Process

Initial Consultation
We'll discuss your situation, answer your questions, and explain your options. You'll leave understanding the process ahead and what to expect.
Filing the Petition
One spouse files a Petition for Dissolution of Marriage with the court. The other spouse is served and has 21 days to respond (35 days if served out of state).
Disclosure & Discovery
Both parties exchange financial information. In complex cases, we may conduct formal discovery including depositions and subpoenas.
Temporary Orders
If needed, we can request temporary orders for support, parenting time, and property use while the divorce is pending.
Negotiation or Mediation
We work to resolve issues through negotiation or mediation. Many cases settle without trial, saving time, money, and stress.
Trial (If Necessary)
If agreement isn't possible, we'll present your case at trial. Our attorneys are experienced trial lawyers who prepare thoroughly.
Final Decree
The court issues your Decree of Dissolution, officially ending the marriage. In Colorado, this cannot happen until at least 91 days after the petition is filed.
